All content of this website including pictures, designs, logos, photographs, written and other materials is copyrighted. All worldwide rights are reserved. Any reproduction in whole or in part of this website is strictly prohibited without the prior written permission of PCS.
Please be aware that each of various trademarks, product names etc. represented on PCS website is the property of their individual owner-companies. You will not own any intellectual property rights in the products by buying them. The products are sold for non-commercial use as a consumer only.
Shopping at www.paulcocksedgeshop.com is a secure process. Click on the ‘Add to Cart’ icon to add the product you require to your order. You do not have to buy the items and you can still cancel the order at this point.
Should you wish to delete your selection, highlight the product and click on the cross ‘x’ icon next to the product in your cart page. Agree to these ‘Terms and Conditions’ before you check out.
To proceed to the completion of your purchases, click on the ‘Checkout’ icon.
Your credit card or debit card details will then be required together with confirmation of the delivery address. PCS currently accepts Visa, MasterCard, Switch, American Express. Payments are operated via Paypal.
Once you have placed your order you will be sent a confirmatory email and order number. It is the customer’s responsibility to check the confirmatory email and notify PCS immediately of any errors at firstname.lastname@example.org.
Payment will be collected after you place your order and you will then be bound and contracted to proceed to purchase of the products. A second email will be sent on dispatch of the products with a receipted invoice.
If you wish to cancel an order before the order has been processed email email@example.com. as swiftly as possible quoting your order reference number. If the order has already been acted upon you will need to follow our Returns and Refunds Policy.
Cancellation of orders can only be accepted by email. Cancellations will only be accepted within seven working days of receipt of order. After this date, any cancellations may incur a cancellation fee of any expenses incurred by PCS as a result of the cancellation. In case of cancellations of non-standard finishes or volume orders, any deposits will not be refunded.
To do so send an email at firstname.lastname@example.org seven working days of your order, quoting “Cancellation” in the subject heading, and including your email your name, contact details, order number, and stating that you wish to cancel your order. Cancellations received after this statutory cancellation period won’t be valid.
If you have received the products before you cancel your contract then you must send the products back to a postal address PCS will give you at your own cost and risk.
If you cancel your contract but PCS have already processed the products for delivery you must not unpack the products when they are received by you and you must send the products back to a postal address PCS will give you at your own cost and risk as soon as possible.
Once you have notified PCS that you are cancelling your contract, any sum paid to PCS from your credit card will be credited to your account as soon as possible and in any event within thirty days of your order PROVIDED THAT the products in question are returned by you and received by PCS in the condition they were in when delivered to you.
If you do not return the goods delivered to you or do not pay the costs of delivery, PCS shall be entitled to deduct the direct costs of recovering the goods from the amount to be credited to you.
PCS reserve the right to cancel the contract between us if PCS have insufficient stock to deliver the goods you have ordered, PCS do not deliver to your area, or one or more of the products you ordered was listed at an incorrect price owing to a typographical error or an error in the pricing information received by PCS from PCS suppliers.
If PCS cancel your contract PCS will notify you by email and will credit to your account any sum deducted by PCS from your credit card as soon as possible but in any event within thirty days of your order. PCS will not be obliged to offer any additional compensation for disappointment suffered.
If during the execution of an order any events arise such as to make impossible the execution of that order according to order confirmation or such as to cause an unacceptable increase of the primary costs, PCS will be entitled to terminate this contract.
Modifications and Finishes
Whilst every effort is made to ensure accurate representation of product colours, finishes and dimensions, PCS reserve the right to alter these details without notice in compliance with its own production needs, technological changes or in response to the current market situation.
Every effort is made by PCS to ensure colour matches in our products. However, PCS cannot guarantee exact colour matches for any product finishes, or complete uniformity in the finishes of any materials, such as plastic, polystyrene, or wood. It is in the nature of the hand-made process that no two products will look exactly the same, and PCS is not liable for any such irregularities or anomalies that may occur.
PCS offers a twelve month warranty on all products providing such items and relevant accessories are defective or unusable because of verified defects of manufacture or assembling and you have been compliant with the agreed terms of payment. PCS will not accept or pay for any invoices sent by third parties for the repairing of defective products.
The prices displayed on PCS website include 20% value added tax, which is applicable for customers in the UK and the European Union. If you live outside the UK or the EU, this tax will be deduced when you pay for your order. However you may be liable for local import taxes in your home country.
Security of shopping
The security of personal data is of the highest priority.
When you do business with PCS the personal information of your name, postal address, email address, telephone number, credit card number, expiry date security code and any other information required for processing is collected from you by PCS sub-contractors Shopify on behalf of PCS and the personal information of your name, credit card number, expiry date security code and any other information required for payment processing is collected from you by PCS sub-contractor Paypal. PCS requires all such third parties to treat your personal information as fully confidential and to fully comply with all applicable UK Data Protection or Consumer Legislation.
PCS do not store credit card details or share customer details and data with any third parties.
PCS will deliver the products ordered by you to the address you give PCS for delivery at the time you make your order. Delivery will be made as soon as possible after your order is accepted. Please note PCS do not deliver to PO boxes.
Providing the item is in stock, PCS aim to dispatch all orders within 14 working days of receipt and delivery via courier will take up to three working days (UK, EU, USA and Canada) and up to five working days (rest of the world). Your order will be fully trackable, insured and a signature will be required on delivery.
Where an item is available to pre-order, we will give you an estimated delivery date which we cannot guarantee as it may be subject to delays outside of our control. We will aim to keep you informed of changes to this estimated delivery date.
For delivery in the United Kingdom most of our products are delivered by Parcelforce and Royal Mail. When you check out, please choose the service relevant to your area, ie. UK mainland or UK Scottish Highlands and Islands and UK Islands.
Subject to PCS rights of retention of title you will become the owner of the products you have ordered when they have been delivered to you. Once products have been delivered to you they will be held at your own risk and PCS will not be liable for their loss or destruction. PCS reserve the right to alter packaging materials dimensions or weights without prior notice.
PCS shall have no liability to you for any failure to deliver products you have ordered or any delay in doing so or for any damage or defect to products delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
Once PCS has advised you of the tracking details for your order, it is your responsibility to follow this up with the shipping company directly should delays occur. Please note that if the shipping company return the order to PCS following one or more unsuccessful delivery attempts, PCS will charge postage to re-deliver.
Any lead times stated are estimated times only. Lead times for non-standard items and large quantity orders will be advised upon order confirmation.
Retention of title
You agree that title shall transfer to you only when the products have been paid for in full. PCS is entitled to require you to deliver up the products to PCS until such time that all due payments have been made in full. You are required to store the products free of charge and in a manner to ensure the products are safe from theft and damage.
Refunds and returns
All international refunds will be refunded for the equivalent amount taken in pounds sterling on the original order. Owing to fluctuations in the currency exchange rate this may result in a difference between the refunded amount and the original price.
You can return your purchase within fourteen days of receipt. However, you must first contact PCS and get our approval of return. No refunds or exchanges will be made for items returned without prior communication and agreement.
If the products PCS deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, PCS shall have no liability to you unless you notify PCS in writing of the problem within fourteen working days of the delivery of the goods in question quoting ‘Returns Request’ to email@example.com in the subject heading and giving us your name, contact details, order number, reasons for return and whether you request replacement or refund. Once you receive the confimation from PCS you must then return the goods by mail to us within 14 days.
On receipt of your return request and the products PCS will either replace the products or refund the price (as you request) minus a 15% administrative charge, within 30 days receipt of their return. You are responsible for any shipping charges incurred returning the products. Where returned products are unsealed, worn or not in reasonable re-saleable condition or, if return is due to damage or defectiveness caused by you, PCS will not be able to provide any replacement or refund.
If you do not receive the products ordered within fourteen days of the date on which you ordered them, PCS shall have no liability to you unless you notify us in writing at our contact address of the problem within twenty days of the date on which you ordered the products.
If you notify a problem to PCS our only obligation will be, at your option: to make good any shortage or non-delivery; to replace or repair any goods that are damaged or defective; or to refund to you the amount paid by you for the products in question in whatever way we choose minus a 15% administrative charge.
Receipt of products showing obvious damage to the products or packaging must be recorded in writing on the accompanying shipment documentation at the time of delivery and notified to PCS within fourteen days of delivery. Images of packaging and damages must be sent with a condition report form correctly filled out and receipt acknowledged as received by PCS.
Save as precluded by law, PCS will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to PCS under this condition and PCS shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the products in question under this clause.
You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our products to you may be prohibited by certain national laws. PCS make no representation and accept no liability in respect of the export or import of the products you purchase.
Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from PCS negligence.
PCS have no control over the Internet. PCS website and the order processing system and secure online e-commerce payment system on the website are not guaranteed to be error free or uninterrupted. PCS will not be liable for any direct or indirect loss or damage which results or may result from your access to or use of the Internet or the website.
Data protection and privacy
PCS is committed to protecting your privacy. The information we and our sub-contractors collect about you in order to process your order will only be used lawfully in accordance with the Data Protection Act 1998. PCS will not wilfully disclose any confidential information without your prior permission and your details will not be passed onto a third party for their use in promotional purposes.
PCS will not share any of your information with any other parties except to the extent required by law, police, court order or as requested by other government or law enforcement authority.
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
Taxes and duties
The prices listed on the website are exclusive of all local customs charges, duties or taxes payable for import of the products into the territory to which the products are to be delivered. All local customs charges, duties or taxes are payable by you and are the your sole responsibility. In the event of the return of products to PCS as a result of the failure or refusal by you to pay any local customs charges, duties or taxes, any cost incurred by PCS by return of the products to PCS will be deducted and retained from any refund payable to you.
Third Party Rights, Entire Agreement and Applicable Law
Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the United Kingdom Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.
The agreements regulated by these Terms & Conditions shall be governed by the laws of the United Kingdom and the buyer agrees to submit to the non-executive jurisdiction of the UK courts.
